1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your access to and use of the Find My Royalties™ platform (“FMR”, “we”, “us”, “our”), operated by Lawrence Eastland trading as Find My Royalties™ (ABN 26 367 663 159), Ewingsdale NSW 2481, Australia.

By registering for, accessing, or using the FMR platform — including during the private and public beta periods — you agree to be bound by these Terms. If you do not agree, do not use the platform.

These Terms should be read together with our Privacy Policy.

2. Description of Service

Find My Royalties™ is a music royalty intelligence platform that:

Processes audio recordings using acoustic identity technology (Chromaprint) to generate a unique acoustic identifier per track
Cross-references your track metadata across major streaming platforms and music databases
Identifies metadata discrepancies that may affect royalty attribution
Generates intelligence reports and Evidence Packets for submission to collecting societies and distributors
Provides access to Opus, an AI-powered assistant to help you understand your reports

Beta Period: During the private and public beta, the platform is provided on an access-by-invitation basis. Features, pricing, and functionality may change. We appreciate your participation and feedback.

3. Eligibility

To use FMR, you must:

Be at least 18 years of age
Have the legal right to submit the music catalogue and associated metadata you provide
Be an artist, rights holder, label, publisher, or authorised representative thereof
Provide accurate and complete registration information

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at admin@findmyroyalties.com.au if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or in a way that harms other users.

5. Your Content and Intellectual Property

5.1 Your Rights

You retain full ownership of all music, metadata, and content you submit to FMR (“Your Content”). By submitting content, you grant FMR a limited, non-exclusive, royalty-free licence to process Your Content solely for the purpose of providing the service to you.

5.2 Audio Deletion

Audio files you submit are processed to generate an acoustic identity and then deleted within 7 days. FMR does not store, distribute, or exploit your audio recordings. Only the acoustic identity (~200 bytes) and associated metadata are retained.

5.3 Your Warranty

You warrant that you have the legal right to submit all content provided to FMR, and that doing so does not infringe the intellectual property or other rights of any third party. You indemnify FMR against any claims arising from a breach of this warranty.

6. Find My Royalties™ Intellectual Property

The FMR platform, including its software, algorithms, design, reports, Opus AI assistant, branding, and all related intellectual property, is owned by Lawrence Eastland trading as Find My Royalties™. Nothing in these Terms transfers ownership of FMR’s intellectual property to you.

You may not copy, modify, reverse-engineer, distribute, or create derivative works from any part of the FMR platform without our prior written consent.

7. Acceptable Use

You agree not to use the FMR platform to:

Submit content you do not have the right to submit
Attempt to reverse-engineer, scrape, or extract data from the platform
Circumvent security measures or access controls
Submit false, misleading, or fraudulent information
Use the platform for any unlawful purpose
Harass, impersonate, or harm other users
Introduce malicious code, viruses, or disruptive technology

8. Reports, Evidence Packets, and Accuracy

FMR provides metadata intelligence reports and Evidence Packets based on automated analysis of your catalogue against available platform data. These reports are provided as informational tools to assist you in identifying and addressing potential metadata discrepancies.

Important: FMR reports do not constitute legal advice, accounting advice, or a guarantee of royalty recovery. The accuracy of reports depends on the completeness and accuracy of data available from third-party platforms, which may be incomplete or out of date.

Decisions about submitting corrections to collecting societies, distributors, or other bodies remain yours. We recommend seeking independent legal or industry advice where appropriate.

9. Opus AI Assistant

Opus is an AI-powered assistant embedded in the FMR dashboard, powered by Anthropic’s Claude API. Opus is designed to help you understand your reports and royalty concepts.

You acknowledge that:

Opus responses are generated by an AI and may not always be accurate or complete
Opus does not provide legal, financial, or accounting advice
Conversations with Opus are processed by Anthropic in accordance with their terms and privacy policy
Opus does not retain conversation history across sessions
For complex or high-stakes matters, you should seek qualified professional advice

10. Third-Party Services

FMR integrates with third-party services including Spotify, YouTube, TIDAL, MusicBrainz, Discogs, Anthropic, DigitalOcean, and others. We are not responsible for the availability, accuracy, or conduct of these third-party services. Your use of linked third-party services is subject to their own terms and privacy policies.

11. Limitation of Liability

To the maximum extent permitted by Australian law, FMR’s liability for any claim arising from your use of the platform is limited to the amount you paid to FMR in the 12 months preceding the claim (or AUD $100 if no fees were paid, such as during the beta period).

FMR is not liable for indirect, incidental, special, or consequential loss, including loss of revenue, loss of royalties, loss of data, or loss of opportunity, even if advised of the possibility of such loss.

Nothing in these Terms excludes any guarantee, warranty, or right that cannot be excluded under the Australian Consumer Law.

12. Disclaimer of Warranties

The FMR platform is provided “as is” and “as available”, particularly during the beta period. We do not warrant that the platform will be uninterrupted, error-free, or that all metadata discrepancies will be identified. We make no warranty that use of the platform will result in royalty recovery.

13. Indemnity

You agree to indemnify and hold harmless Lawrence Eastland trading as Find My Royalties™, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal costs) arising from: (a) your use of the platform; (b) Your Content; (c) your breach of these Terms; or (d) your violation of any third-party rights.

14. Termination

Either party may terminate access to the platform at any time. We may suspend or terminate your access immediately if you breach these Terms, or for operational reasons during the beta period.

On termination, your right to use the platform ceases. We will handle your data in accordance with our Privacy Policy. Clauses that by their nature should survive termination (including Sections 5, 6, 11, 12, 13) will continue to apply.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

16. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email and update the effective date above. Continued use of the platform after notification constitutes acceptance of the updated Terms. The current version is always available at findmyroyalties.com.au/terms.
